Terms of Use

1. Agreement and scope

These Terms of Use form a binding agreement between you (personally or on behalf of the entity you represent) and Silverstone Industrial (“SIND”, “we”, “us”) for access to sind-parts.ltd and its related services. Separate Terms of Sale apply to quotations and purchases. If you do not agree to these terms, you must stop using the site.

2. The services

The site provides information about compatible compressed-air parts, a quote-request channel, account features and related content. Product references, part numbers and fitment information are provided for identification and enquiry. They are not engineering advice and are not a substitute for the machine manufacturer’s documentation or a qualified assessment.

3. Intellectual property

We own or license the site’s design, code, databases, text, photographs, graphics and the Silverstone Parts marks. You may view and print pages for your internal business use. You may not copy, republish, scrape, aggregate, resell or commercially exploit any part of the site without our prior written permission. OEM names, trademarks and part numbers belong to their respective owners and are used only to identify equipment or parts.

4. Your representations

By using the site you confirm that you have legal capacity to agree to these terms; that you are at least 18; that you will not access the site through automated means except as permitted by our robots instructions or a search engine’s normal operation; that your use is lawful; and that the information you provide is accurate and complete.

5. Prohibited activities

You may not: systematically retrieve data to build a collection, database or directory; use bots, scrapers or other automated tools to access the site; circumvent security or access controls; interfere with the site or place an undue load on it; upload malware or harmful code; impersonate another person; harvest email addresses or create accounts by automated means; use the site to compete with us; or use the site in breach of any law. We may suspend or block access for any breach.

6. Submissions

If you send us a question, suggestion, idea or feedback, you grant us a non-exclusive, perpetual, royalty-free licence to use it to operate and improve our services. Do not send confidential information through the site. You are responsible for ensuring you have the right to send anything you upload.

7. Services management and termination

We may monitor the site for breaches, remove content, restrict access, or suspend or terminate an account at any time if we reasonably believe these terms or the law have been breached. We may also suspend the site for maintenance. We are not liable for loss caused by suspension, discontinuance or inability to access the site.

8. Modifications

We may change, update or remove site content, features or these terms at any time. The “Last updated” date shows the current version. Continued use after a change means you accept the revised terms. We do not undertake to keep every page current, and prices, availability and specifications may change.

9. Third-party links

The site may link to third-party websites. We do not control them and are not responsible for their content, products, security or privacy practices. A link is not an endorsement.

10. Disclaimer

The site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or free of harmful components, or that any content is complete, accurate or current. Product references and cross-references are for identification only; see the Terms of Sale for fitment responsibility.

11. Limitation of liability

To the fullest extent permitted by law, we and our directors, employees and agents are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, including lost profit, lost revenue, lost production or lost data, arising from your use of the site. Our total liability for any claim relating to the site is limited to the greater of the amount you paid us for the service giving rise to the claim or US$100. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by our negligence.

12. Indemnification

You agree to defend, indemnify and hold us harmless from claims, losses, liabilities, damages and reasonable legal costs arising from your breach of these terms, your violation of law or the rights of a third party, or your misuse of the site. We may assume the defence of a covered claim at your expense, and you agree to cooperate.

13. Governing law and disputes

These terms are governed by the laws of the People’s Republic of China. The parties will first try to resolve a dispute by written negotiation. If it is not resolved, the dispute will be submitted to the China International Economic and Trade Arbitration Commission (CIETAC) in Shanghai for arbitration. The language of the arbitration is English. Nothing in this clause prevents either party from seeking urgent injunctive relief from a competent court.

14. Electronic communications

Visiting the site, sending us email and completing online forms are electronic communications. You consent to receive communications electronically, and agree that notices, disclosures and records we provide electronically satisfy any requirement that they be in writing. You may withdraw consent to marketing email at any time, but transactional and legal notices may still be sent electronically.

15. Miscellaneous and contact

These terms and our Terms of Sale, Privacy Policy and Cookie Policy form the entire agreement about the site. If a provision is unenforceable, it is severed and the remainder continues. A failure to enforce a provision is not a waiver. We may assign our rights and obligations. No agency, partnership or employment relationship is created. Contact: contact@sind.ltd.
